Welcome to 281 Country Club. By accessing our website, making a reservation, renting equipment, participating in activities, or using our services, you agree to be bound by these Terms and Conditions.

1. Acceptance of Terms

By accessing or using our website, services, facilities, activities, rentals, or reservation systems, you agree to these Terms and Conditions. If you do not agree, do not use our services.

2. Eligibility

Participants must meet all applicable age, safety, identification, and operational requirements established by 281 Country Club. Certain activities may require a valid government-issued photo ID, a valid payment method, and adherence to minimum age restrictions.

2A. Minors and Parental Responsibility

All minors under the age of 18 must be accompanied by and remain under the supervision of a parent or legal guardian at all times. A parent or legal guardian must complete all required waivers and releases on behalf of any minor participant. 281 Country Club reserves the right to deny participation if age or safety requirements are not met.

2B. Passengers and Adult Responsibility

The adult operator and/or supervising parent or guardian assumes full responsibility for any passenger. The supervising adult is responsible for ensuring all passengers wear required safety equipment, follow safety instructions, and comply with all applicable rules.

2C. Helmets and Safety Equipment

Helmets may be provided for participant use. Refusal to wear required safety equipment may result in denial of participation without refund.

3. Reservations

Reservations are subject to availability. 281 Country Club reserves the right to refuse, modify, reschedule, or cancel reservations for safety, operational, weather-related, or business reasons.

4. Payment Authorization

By making a reservation, customers authorize 281 Country Club to process payments, deposits, security holds, damage charges, or other authorized charges associated with the reservation.

5. Security Hold Requirements

Certain reservations may require government-issued photo ID, verification of payment method, and security deposits or holds. Failure to provide required documentation may result in cancellation.

6. Waivers and Releases

Participation may require completion of liability waivers and assumption-of-risk agreements. Failure to complete required documents may result in denial of participation.

7. Assumption of Risk

Participants understand that recreational and outdoor activities involve inherent risks including personal injury, property damage, equipment failure, and environmental hazards. Participation is voluntary and at the participant's own risk.

8. Customer Responsibilities

Customers agree to follow all safety instructions, operate equipment responsibly, comply with applicable laws, and immediately report accidents or equipment issues. 281 Country Club reserves the right to terminate participation without refund if safety rules are violated.

9. Damage to Property or Equipment

Customers may be financially responsible for damages resulting from misuse, negligence, or violation of operating instructions.

10. Cancellations and Rescheduling

Specific cancellation policies presented during the reservation process shall govern the reservation.

11. Weather and Safety Conditions

281 Country Club may modify, delay, reschedule, or cancel activities due to weather, safety concerns, maintenance, or circumstances beyond our control.

12. Limitation of Liability

To the fullest extent permitted by law, 281 Country Club, its owners, employees, agents, and affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from participation in activities or use of our services.

13. Indemnification

Participants agree to indemnify and hold harmless 281 Country Club and its affiliates from claims, liabilities, damages, and expenses arising from participation or violation of these Terms and Conditions.

14. SMS Terms of Service

By providing your mobile phone number and opting in during the reservation process, you consent to receive SMS communications from 281 Country Club.

These messages may include:

• Reservation confirmations
• Reservation reminders
• Reservation updates
• Waiver reminders
• Security hold notifications
• Customer support communications

Consent to receive SMS messages is not a condition of purchase.

Customers opt in by selecting a separate SMS consent checkbox during the reservation process. The checkbox is not pre-selected. SMS consent is collected independently from acceptance of these Terms and Conditions.

Mobile phone numbers, SMS consent, and text messaging originator opt-in data will not be shared, sold, rented, transferred, or disclosed to any third parties or affiliates for marketing or promotional purposes.

15. Privacy

Use of our services is also governed by our Privacy Policy.

16. Governing Law

These Terms and Conditions shall be governed by the laws of the State of Texas.

17. Changes to Terms

281 Country Club reserves the right to update these Terms and Conditions at any time. Changes become effective upon posting to the website.
